Effective date: October 27, 2026
These Terms and Conditions (‘Terms’) are a binding agreement between you and COMPANY NAME (‘we’, ‘us’, ‘our’). They govern your use of https://itsmazic.com/ (the ‘Site’) and any services or products we offer through it. By accessing or using the Site, or by placing an order, you agree to these Terms and to our Privacy Policy, Cookie Policy, Refund Policy, and Disclaimer. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, and legally able to enter a contract (in India, a person competent to contract under the Indian Contract Act, 1872). If you use the Site on behalf of a business, you confirm you have authority to bind that business, and ‘you’ includes it.
2. Our services
The Site provides information about our business and lets you contact us, request quotes, and, where offered, buy services or products. Browsing the Site or contacting us does not create a professional, advisory, fiduciary, or agency relationship. We may change, suspend, or discontinue any part of the Site or our services at any time. Descriptions, images, and prices are shown in good faith, but errors and omissions can occur, and we may correct them.
3. Accounts
If the Site offers accounts, you are responsible for keeping your login details confidential and for all activity under your account. Give us accurate, current information and tell us promptly at dipanshu@itsmazic.com if you suspect unauthorized use. We may suspend or close accounts that breach these Terms or appear to be fraudulent or inactive.
4. Electronic communications and signatures
You agree that we may send you notices, agreements, invoices, and other records electronically, and that clicking ‘accept’, ‘submit’, or similar, or replying by email, can form a binding signature and agreement. This is intended to be valid under laws such as the US E-SIGN Act and UETA, the EU eIDAS Regulation, the UK Electronic Communications Act 2000, and the Indian Information Technology Act, 2000.
5. Orders, quotes, pricing, and payment
If you buy from us or accept a quote:
- Prices are shown in $. Unless stated, they exclude taxes such as VAT, GST, and sales tax, which are added where required.
- A quote is valid for 30 days unless stated otherwise. A contract is formed only when we confirm your order in writing or begin the work, not when you submit it. We may refuse or cancel an order, for example because of a pricing error, suspected fraud, or lack of availability, and will refund anything you paid for it.
- Payment is due as stated on the order or invoice. We may charge interest on late payments at the highest rate the law allows, recover reasonable collection costs, and pause work until overdue amounts are paid.
- Payments are processed by third-party providers under their own terms. We do not store full card details. You confirm you are authorized to use the payment method.
- Refunds and cancellations are covered by our Refund Policy.
- Third-party costs (for example domains, hosting, licences, stock assets, and advertising spend) are billed at cost unless agreed otherwise and are not included in our fees.
6. Subscriptions and renewals
If you buy a recurring plan, it renews automatically for the same period until cancelled. Before you subscribe, we show the price, billing period, renewal terms, and how to cancel. You can cancel at any time through your account settings or by emailing dipanshu@itsmazic.com, and cancellation is as easy as sign-up. We remind you before renewal where the law requires. Price changes take effect at the next renewal after at least 30 days’ notice.
7. Your consumer rights
If you are a consumer, you may have rights that cannot be limited by contract, such as the 14-day right to cancel distance contracts in the EU and UK, guarantees under the Australian Consumer Law, rights under the UK Consumer Rights Act 2015, the Indian Consumer Protection Act, 2019, and state consumer laws. Nothing in these Terms removes those rights. Our Refund Policy explains how to use them.
8. Acceptable use
You agree not to:
- break any law, or infringe anyone’s intellectual property, privacy, or other rights
- upload malware, or attempt to disrupt, probe, overload, or gain unauthorized access to the Site, its servers, or other users’ accounts, or run security tests without our written permission
- scrape, crawl, or harvest content or data in bulk, or use the Site’s content to train machine-learning or AI models, without our written permission
- impersonate any person, or misrepresent your identity or affiliation
- send spam, phishing, or unlawful, harassing, defamatory, hateful, obscene, or deceptive material
- use the Site to build a competing product by copying our content, code, or design
- circumvent technical limits, access controls, or payment mechanisms
- use the Site if you are subject to sanctions or located in an embargoed jurisdiction (see section 17)
9. Intellectual property and copyright complaints
The Site and its content, including text, graphics, logos, code, and layout, belong to us or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to view and use the Site for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of it without our written permission.
If we create work for you, then unless a signed agreement says otherwise, ownership of the final deliverables passes to you on full payment. We keep ownership of our pre-existing tools, templates, code libraries, and methods, license them to you as needed to use the deliverables, and may show completed work in our portfolio.
Copyright complaints. If you believe content on the Site infringes your copyright, send a notice marked ‘Copyright notice’ to dipanshu@itsmazic.com with: your contact details; a description of the work; the URL of the material; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and you are the owner or authorized to act; and your physical or electronic signature. We may remove material and terminate repeat infringers. You may send a counter-notice in the same way.
10. Content you send us
If you submit content, such as reviews, comments, messages, or files, you confirm you own it or have the right to submit it, and that it is lawful and accurate. You give us a non-exclusive, worldwide, royalty-free, sublicensable licence to use, display, and reproduce it in connection with the Site and our services (and, for testimonials you approve, in our marketing). We may moderate and remove content that breaches these Terms or the law, and, where required (for example by the EU Digital Services Act or Indian IT Rules), will give you a way to report illegal content to dipanshu@itsmazic.com.
11. Feedback
If you give us ideas or suggestions, we may use them without restriction or payment, and you waive any claim to them.
12. Third-party links and services
The Site may link to or rely on third-party sites and services. We do not control them and are not responsible for their content, availability, or practices. Your use of them is at your own risk and subject to their terms.
13. Disclaimers
The Site and its content are provided ‘as is’ and ‘as available’. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Site will be uninterrupted, error-free, or secure, or that results, rankings, traffic, or revenue will be achieved. Please also read our Disclaimer. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
14. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Site, even if we were told they were possible. Our total liability for any claim connected with the Site or our services is limited to the total fees you paid us for the service that gave rise to the claim in the twelve months before the claim. If you paid us nothing, we are liable only to the extent the law does not allow us to exclude that liability.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or, for consumers, any liability the law will not let us exclude. Some places do not allow certain exclusions, so parts of this section may not apply to you.
15. Indemnity
You agree to defend, indemnify, and hold harmless us, our directors, employees, contractors, and partners against claims, losses, and costs (including reasonable legal fees) arising from your breach of these Terms, your content, or your misuse of the Site. This does not apply to consumers where the law forbids it.
16. Events beyond our control
We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, epidemics, war, terrorism, strikes, power or network failures, third-party platform outages, cyberattacks, or government action. Where that continues for more than 30 days, either party may end the affected order, and we will refund amounts paid for services not delivered.
17. Export controls and sanctions
You confirm that you are not on a sanctions or restricted-party list and will not use the Site in breach of applicable export-control or sanctions laws, including those of the United States, the European Union, the United Kingdom, and India.
18. Suspension and termination
We may suspend or end your access at any time, with or without notice, if you breach these Terms, if we must do so for legal or security reasons, or if we stop offering the Site. You may stop using the Site at any time. Sections that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, limitation of liability, indemnity, and governing law, will survive.
19. Governing law and disputes
These Terms are governed by the laws of [governing law], without regard to its conflict-of-law rules. Before starting a formal claim, please contact us at dipanshu@itsmazic.com so we can try to resolve the matter informally within 30 days. If that fails, the parties will first try mediation in good faith, and then the courts of location have exclusive jurisdiction.
If you are a consumer, nothing here removes your right to bring a claim in the courts of your home country, to rely on its mandatory consumer laws, or to use any dispute-resolution body that is available to you. Any claim must be brought within one year after it arises, or the shortest period the law allows.
20. Accessibility
We aim to make the Site usable by everyone and to meet WCAG 2.1 level AA where practicable. If you have trouble using any part of it, contact dipanshu@itsmazic.com and we will try to give you the information another way.
21. Changes to these Terms
We may update these Terms from time to time. The effective date above shows the latest version. If a change is material, we will give notice on the Site or by email at least 14 days before it applies, unless the law or a security issue needs faster action. Orders already accepted stay under the Terms in force when you placed them. Continued use of the Site after changes take effect means you accept them.
22. General
These Terms, with the policies named above and any signed agreement with you, are the entire agreement between us on this subject and replace earlier discussions. If a provision is found unenforceable, the rest stays in force and the provision is limited to the minimum extent needed. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor. No one other than you and us has rights to enforce these Terms. Headings are for convenience only. If a translation differs from the English version, the English version prevails. Notices to us go to Business Address and dipanshu@itsmazic.com; we may give notices to the contact details you provided.
